Reconsideration, Review and Appeal of Decisions Policy

The RACMA Reconsideration, Review and Appeal of Decisions Policy provides formal processes for the request of further consideration of certain College decisions.  

The policy clearly outlines the decisions that can be reconsidered, reviewed and formally appealed, and the pathways to enable resolution.

The Three Phases of Reconsideration, Review and Formal Appeal

The key specificities and timelines for each phase are outlined below. 

It is necessary to first complete a reconsideration process before being able to apply for a review and complete the review process before being able to apply for an appeal, except where otherwise allowed under section 4.4 of the policy. Read the policy for further details.  

Phase One – Reconsideration 

An Applicant can request the reconsideration of a decision in scope of this policy within 28 calendar days of receipt of the notification of the decision (14 calendar days when requesting a reconsideration of an Oral Examination outcome). 

The reconsideration is an internal process undertaken by the person or entity responsible for the original decision. 

Phase Two – Review  

Where the Applicant is not satisfied with the outcome of the reconsideration, they can request a review within 14 calendar days of receipt of the notification of the reconsideration outcome. 

The review is an internal process undertaken by a Review Panel, comprised of three people chosen by the Chief Executive for this purpose.  

Phase Three – Formal Appeal 

Where the Applicant is not satisfied with the outcome of the review, they can lodge a formal appeal. They must notify their intention of doing so within 14 calendar days of receipt of notification of the review outcome, and lodge their appeal within nine weeks of the receipt of notification of the review outcome. 

The formal process is undertaken by an Appeals Committee, an ad hoc committee of the Board, convened by the Chief Executive.  

Application Fees 

The College may require that the Applicant pay an application fee for an application for reconsideration, review and appeal. The application fees are published on the College fees page.   

The College will refund the application fee if the application has been successful.  

A request for the Chief Executive to waive all or part of an application fee may also be made by the Applicant at the time of application or notification of their intention to request a reconsideration, review or appeal.  The Applicant must send the request in writing to the Chief Executive and provide justification for their request (e.g., financial hardship).  The request for the waiver of fees will be reviewed and the Applicant will be notified of the outcome before the due date of lodgement of their application for reconsideration, review or appeal.
